It will be democratic (everybody will speak - but who will listen to them) and then the few will decide.
the outcome is of lesser importance. if you don't agree, you write your own agreement, just like there are more or less 14 different big open source contract models out there. Who is there to stop you. You won't have the stamp of free software, but you stay free (open source or not) and your users won't care less, except for those that don't respect your work or code anyway.
Open source, re-usabel source, closed source, free program but paid source. I couldn't care less, as long as the software stays free of cheap.
